Supreme Court Appointment a chicken and egg situation

AbNoynoy has been heard proclaiming that he’s not going to recognize the appointment of SC Chief Justice Renato Corona. A lot of people are applauding his stand (particularly the Yellow Army) but some legal luminaries are also frowning. They said that AbNoynoy is ill advised by people around him.

Senator Juan Ponce Enrile is quoted as saying this:

“Abnoynoy Aquino cannot appoint the next chief justice to replace Reynato Puno, no matter how much he salivates for that authority. “I respect the opinion of AbNoynoy, but I think he should instead be thankful to President Arroyo because if the sitting president hesitates to appoint a chief justice, AbNoynoy cannot appoint a chief justice, if [candidates for the post] have to pass through the [Judicial and Bar Council],” Enrile said.

There cannot be a JBC when AbNoynoy Aquino assumes the presidency on June 30 without a chief justice, Enrile explains, because the JBC recommends appointees to the judiciary and the president selects from those chosen by the JBC.”That’s very clear in the Constitution, the chief justice is the ex-officio chairman of the JBC. If he is not there, the JBC cannot function,” Enrile said. “My God, these people must study the Constitution first before they open their mouths.”

Wala namang alam! We really deserve the government that we have.
